Privacy Policy
This privacy policy ("Policy") details the commitment by Initial Call, a Texas corporation ("B2BSalesMagic", "We", "Us", "Our") to protecting the privacy of individuals ("Users", "Members", "You", "Your") who a) visit, use, download, or engage with any of Our websites, tools, downloads, or digital assets ("Digital Content"); b) request Us to contact You; c) attend or register to attend Our events, Our sponsored events, or any other event at which We participate ("Events"); or d) use Our Digital Content as defined in the Terms and Conditions. This Policy describes how We collect, use, share and secure the User Information that You provide. It also describes Your choices regarding use, access, and correction of Your User Information. All privacy-related requests described in this Policy should be directed to Us as described in Section 8.3.
1. SCOPE OF THIS POLICY
1.1 Our Digital Content may contain links to other websites, content, or tools ("3rd-Party Content"). The information practices and the content of 3rd-Party Content are governed by the privacy statements of third-parties. We encourage You to review the privacy statements of 3rd-Party Content to understand their information, data collection, and data usage practices.
2. INFORMATION YOU PROVIDE TO US
2.1 We ask for and may collect personal information about You such as Your name, address, phone number, email address, instant messaging ID, and credit card information, as well as certain related information like Your company name and website name (“User Information”), when You register for an account to access or utilize one or more of Digital Content (an "Account"). We also ask for and collect User Information such as an email address and a name or alias from any individual that You authorize to log into and utilize Digital Content. We base the processing of Your User Information on Our legitimate interest to provide You with the necessary functionality required during Your use of Our Digital Content;
2.2 A third-party payment processor (e.g., Stripe) is used to manage payment processing. This processor is not permitted to store, retain, or use Your billing information for any purpose except payment processing on Our behalf. We retain only non-sensitive transaction records such as transaction IDs, transaction amounts, and the last four digits of a payment card, solely for billing and record keeping purposes.
2.3 By providing Us with Your User Information, You represent that You are the owner of User Information or otherwise have the requisite consent to provide it to Us.
2.4 We may ask for and collect User Information from You when You submit web forms on the Digital Content or as You use interactive features of the Digital Content, including: participation in surveys, contests, promotions, sweepstakes, requesting customer support, or otherwise communicating with Us. We process Your User Information to perform Our contract with You for the use of Digital Content and to fulfill Our obligations under the Terms and Conditions.
2.5 We may ask for and collect User Information such as Your name, address, phone number and email address when You register for or attend an Event, in order to facilitate Your registration or attendance at an event, including sending related communications to You.
2.6 When You download and use Digital Content, We automatically collect information on the type of device You use, and the operating system version, to perform Our Agreement with You.
2.7 We collect User Information such as Your name, email address, and other information as deemed necessary and relevant when You opt in to receive digital resources, guides, tools, or other lead magnets offered through Our Digital Content ("Digital Tools"). By submitting Your information to access Our Digital Tool, You consent to receive follow-up communications from Us related to that resource and Our services. You may opt out of these communications at any time by clicking the "unsubscribe" link in any email or by contacting Us per Section 8.3. We retain Digital Tools opt-in data for as long as You remain an active subscriber or member. Upon opt-out or data deletion request, We will remove Your information in 45 days, except where retention is required by law or legitimate business record-keeping.
2.8 We may ask You to submit content through participation of Our Member Activities or usage of Our Digital Tools, including but not limited to content samples, recorded presentations, podcast appearances, or other performance materials. You may request deletion of any of Your submitted materials at any time by contacting Us per Section 8.3.
2.9 Certain paid versions of Our Digital Content require the collection of User Information in order to personalize the content for You (“Personalized Content”). By submitting payment and consenting to provide Your User Information, You acknowledge and consent that any User Information and Personalized Content will be collected, stored, and used as described in Section 2.8. A generic acceptance of Our Terms and Conditions and Privacy Policy at the point of registration or payment constitutes Your informed consent to this collection and use. If You have questions about what specific information is collected in connection with a paid Digital Content prior to submitting payment, You may contact Us per Section 8.3 before proceeding.
3. INFORMATION THAT WE COLLECT FROM YOU
3.1 We and Our authorized partners may use cookies and other information gathering technologies for a variety of purposes. These technologies may provide Us with User Information, information about devices and networks You utilize to access the Digital Content, and other information regarding Your interactions with the Digital Content.
3.2 We may partner with third parties to either display advertising on the Digital Content or to manage Our advertising on other sites. Our third party partners may also use technologies such as cookies to gather information about Your activities on the Digital Content and other sites in order to suggest advertisements based upon Your browsing activities and interests. If You wish to not have this information used for the purpose of serving You interest-based ads, You may opt-out by by submitted your preferences via TrustArc, a third party service provider. Please note this does not opt You out of being served ads and You will continue to receive generic, untargeted ads.
3.3 Web beacons, tags and scripts may be used on the Digital Content or in email or other electronic communications We send to You. These assist Us in delivering cookies, counting visits to the Digital Content, understanding usage and campaign effectiveness and determining whether an email has been opened and acted upon. We may receive reports based on the use of these technologies by Our third-party service providers on an individual and aggregated basis.
3.4 We use Local Storage Objects ("LSOs") such as HTML5 to store content information and preferences. Various browsers may offer their own management tools for removing HTML5 LSOs. Third parties with whom We partner to provide certain features on the Digital Content or to display advertising based upon Your Web browsing activity use LSOs such as HTML5 to collect and store information.
3.5 We gather certain information and store it in log files when You interact with the Digital Content. This information includes internet protocol (IP) addresses as well as browser type, internet service provider, URLs of referring/exit pages, operating system, date/time stamp, information You search for, locale and language preferences, identification numbers associated with Your devices, Your mobile carrier, and system configuration information. Occasionally, We connect User Information to information gathered in Our log files as necessary to improve the Digital Content. In such a case, We would treat the combined information in accordance with this Policy.
3.6 We collect analytics information when You use the Digital Content to help Us improve them, including through the use of cookies. We may also share non-identifiable data about Your actions on the Digital Content with third-party service providers of analytics services. We also use mobile analytics software to allow Us to better understand the functionality of Our mobile versions of Digital Content on Your mobile device. This software may record information such as how often You use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information We store within the analytics software to any personally identifiable information You submit within the mobile application.
3.7 In the course of operating Our business, We may use artificial intelligence tools, including Claude (provided by Anthropic, Inc.) and Gemini (provided by Google LLC), to assist with internal business functions such as analysis and content training. If You or Your information is referenced in content entered into these tools, that content may be processed by those third-party AI providers in accordance with their respective privacy policies. We take reasonable care to limit the User Information entered into AI tools and do not use these tools to make automated decisions about You. You can review the privacy practices of these providers at anthropic.com and google.com respectively.
4. INFORMATION COLLECTED FROM OTHER SOURCES
4.1 The Digital Content include social media features, such as the "Share This" button or interactive mini-programs that run on the Digital Content. These features may collect Your Internet protocol address, which page You are visiting on the Digital Content, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Digital Content. Your interactions with these features are governed by the privacy statement of the companies that provide them.
4.2 We may also obtain other information, including User Information, from third parties and combine that with information We collect through the Digital Content. For example, We may have access to certain information from a third party social media or authentication service if You log into Digital Content through such a service or otherwise provide Us with access to information from the service. Any access that We may have to such information from a third party social media or authentication service is in accordance with the authorization procedures determined by that service.
If You authorize Us to connect with a third party service, We will access and store any information provided to Us, such as: Your name, email address(es), location, profile picture URL, and other User Information that the third party service makes available to Us, and use and disclose it in accordance with this Policy. You should check Your privacy settings on these third party services to understand and change the information sent to Us through these services. For example, You can log in to the Digital Content using single sign-in services such as Google Single Sign-On, Microsoft Office 365 Single Sign-On, Facebook Connect or an OAuth2 provider to integrate Digital Content with third party applications.
These single sign-on services will authenticate Your identity, provide You with the option to share certain User Information (such as Your name and email address) with Us, and pre-populate Our sign up form. Some third party services like Facebook Connect give You the option to post information about Your activities in the Digital Content to Your profile page to share with others within Your network.
5. HOW WE USE INFORMATION THAT WE COLLECT
5.1 We may use the information We collect about You (including User Information, to the extent applicable) in order to perform Our obligations under Our Terms and Conditions with You, to provide You with Digital Content, and on the basis of Our legitimate interest including to (a) provide, operate, maintain, improve, and promote the Digital Content; (b) enable You to access and use the Digital Content; (c) process and complete transactions, and send You related information, including purchase confirmations and invoices; (d) send transactional messages, including responses to Your comments, questions, and requests; provide customer service and support; and send You technical notices, updates, security alerts, and support and administrative messages; (e) send promotional communications, such as providing You with information about products and services, features, surveys, newsletters, offers, promotions, contests, and events; and provide other news or information about Us and Our partners (You can opt-out of receiving marketing communications from Us by providing Us with name(s) and email address(es) You want opted out by contacting Us per Section 8.3 or following the unsubscribe instructions included in Our marketing communications); (f) process and deliver contest or sweepstakes entries and rewards; (g) monitor and analyze trends, usage, and activities in connection with the Digital Content and for marketing or advertising purposes; (h) investigate and prevent fraudulent transactions, unauthorized access to the Digital Content, and other illegal activities; (i) personalize the Digital Content, including by providing features or advertisements that match Your interests and preferences; and (j) for other purposes for which We obtain Your consent.

6. SHARING OF INFORMATION COLLECTED
6.1 We may share information, including User Information, with third-party service providers that help Us operate Our business. These providers include, but are not limited to, services for: website hosting and infrastructure (e.g. Google Workspace and Airtable, Slack), payment processing (e.g., Stripe), email marketing and CRM (e.g., Close, Substack, and Pipelineapp.io), analytics, and customer support. Each provider receives only the User Information necessary to perform their specific function and is contractually prohibited from using Your data for their own marketing purposes or for any purpose beyond the services they provide to Us. A current list of our key service providers is available upon request by contacting Us per Section 8.3 .
6.2 In certain situations, We may be required to disclose User Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may disclose User Information to respond to subpoenas, court orders, or legal process, or to establish or exercise Our legal rights or defend against legal claims. We may also share such information if We believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Our Service Agreement, or as otherwise required by law.
6.3 From time to time, We may post testimonials on the Digital Content that may contain User Information. We obtain Your consent to post Your name along with Your testimonial. If You wish to update or delete Your testimonial, You can contact Us per Section 8.3.
6.4 If You choose to use Our referral service to tell a friend about Our products and services, We will ask You for Your friend's name and email address. You must only provide Your friend's name and email address if You have a reasonable belief they will not object to Us contacting them. If You do, We will automatically send Your friend an email inviting him or her to visit the Digital Content and will store this information for the purpose of sending this initial email, tracking the success of Our referral program and other marketing activities. Your referral may contact Us per Section 8.3 to request that We remove his/her information from Our database.
6.5 The Digital Content may offer publicly accessible blogs, community forums, comments sections, discussion forums, or other interactive features ("Interactive Areas"). You should be aware that any information that You post in an Interactive Area might be read, collected, and used by others who access it. To request removal of Your User Information from an Interactive Area, contact Us per Section 8.3. In some cases, We may not be able to remove Your User Information, in which case We will let You know if We are unable to do so and why.
6.6 We may share information, including User Information, with any member of Us, and they will use that information only for the purposes already described in this Policy.
6.7 We may also share User Information with third parties when We have Your consent to do so.
6.8 You acknowledge and consent that Your professional contact information, including Your name, email address, phone number, company name, and professional background, may be shared with other Members as part of the referral, introduction, and business development activities that constitute Member Activities. Such member-to-member sharing is limited to professional contexts and is a fundamental function of Our membership. Members who receive Your contact information through participating in Member Activities are expected to use it solely for professional purposes consistent with the community's standards. If You wish to restrict how Your contact information is shared within the Our community, You may contact Us per Section 8.3 to discuss available options, which may affect Your ability to participate in certain membership activities.
7. HOW WE PROTECT AND RETAIN YOUR INFORMATION
7.1 We retain User Information collected from Users indefinitely until a deletion request is submitted. Upon receiving a verified deletion request, We will remove Your User Information within 45 days, except where retention is required by law or legitimate business record-keeping purposes.
7.2 We retain log data such as IP addresses, browser type, and system configuration information collected through Your interactions with Our Digital Content for a period of one (1) year, after which it is deleted or aggregated.
7.3 If it is not possible to delete Your User Information immediately (for example, because Your information has been stored in backup archives), We will securely store Your User Information and isolate it from any further processing until deletion is possible.
7.4 We protect Your User Information using the following measures:
- Encryption: Your User Information is encrypted both in transit and at rest to prevent unauthorized access.
- Access Controls: Access to Your User Information is limited to authorized personnel only, who are required to handle it in accordance with this Policy.
- Trusted Infrastructure: We rely on reputable third-party service providers, such as Google Workspace, Stripe, and Airtable, who maintain their own industry-standard security practices to protect the data they process on Our behalf.
7.5 We store User Information primarily within the United States. If We transfer Your User Information to third parties or service providers outside the United States, We will ensure that appropriate safeguards are in place to protect Your data in compliance with applicable law.
8. HOW TO EXERCISE YOUR DATA PROTECTION RIGHTS
8.1 You have certain choices available to You when it comes to Your User Information. Below is a summary of those choices, how to exercise them and any limitations.
8.2 You have the following data protection rights:
- Right to Know: You may request that We disclose the categories and specific pieces of User Information We have collected about You, the categories of sources from which it was collected, the business purpose for collecting it, and the categories of third parties with whom We share it.
- Right to Access: You may request a copy of the User Information We hold about You.
- Right to Correct: You may request that We correct any inaccurate User Information We maintain about You.
- Right to Delete: You may request that We delete User Information We have collected from You, subject to certain exceptions where retention is required by law or legitimate business record-keeping.
- Right to Opt-Out: You may opt out of receiving marketing communications from Us at any time by clicking the "unsubscribe" link in any of Our marketing emails, or by contacting Us per Section 8.3.
8.3 All privacy-related requests, inquiries, and communications described in this Policy, including requests to access, correct, delete, or restrict Your User Information, opt-out requests, testimonial updates, referral removals, and vendor list inquiries should be directed to Us at privacy@b2bsalesmagic.club. This is the single point of contact for all data protection matters under this Policy.
8.4 If You are a California resident, You have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to opt out of the sale or sharing of Your User Information. As described in Section 3.2, We may share Your User Information with third-party advertising partners in ways that may constitute a "sale" or "sharing" under California law. To exercise Your right to opt out, please contact Us at privacy@b2bsalesmagic.club with the subject line "Do Not Sell or Share My Personal Information." We will respond within 45 days. We will not discriminate against You for exercising this right.
8.5 We may need to verify Your identity before processing Your request. We will not discriminate against You for exercising any of Your data protection rights.
8.6 Please note that certain information may be retained for legitimate business record-keeping purposes, to complete transactions, or to comply with Our legal obligations, even where a deletion request has been submitted.
8.7 If You wish to exercise any other data protection rights that are available to You under Your local data protection laws (such as the right to data portability or to data restriction) then please contact Us per Section 8.3 and We will action Your request in accordance with applicable data protection laws. You have the right to complain to Your local data protection authority if You are unhappy with Our data protection practices.
9. CHILDREN'S PERSONAL INFORMATION
9.1 We do not knowingly collect any User Information from children under the age of 16 ("Child"). If You are a Child, please do not submit any User Information through the Digital Content. We encourage parents and legal guardians to monitor their Child's Internet usage and to help enforce this Policy by instructing their children never to provide User Information through the Digital Content without their permission. If You have reason to believe that a Child has provided their User Information to Us through the Digital Content, please contact Us per Section 8.3, and We will use commercially reasonable efforts to delete that information.
10. BUSINESS TRANSACTIONS
10.1 We may assign or transfer this Policy, as well as Your account and related information and data, including any User Information, to any person or entity that acquires all or substantially all of Our business, stock or assets, or with whom We merge. If We do, We will inform them of the requirement to handle Your User Information in accordance with this Policy.
11. CHANGES AND UPDATES
11.1 This Policy may be updated from time to time to reflect changing legal, regulatory or operational requirements. We encourage You to periodically review this page for the latest information on Our privacy practices.
11.2 If there are any material changes to this Policy, You will be notified by Our posting of a prominent notice on the Digital Content prior to the change becoming effective. If We are required by law to do so, We will seek Your consent prior to those material changes becoming effective.
11.3 If You do not accept any changes made to this Policy, please discontinue use of the Digital Content.
